Feds could change flood insurance rules for lenders

A group of federal agencies
joined together to create flood insurance policy rules.
A rule proposed would
implement some provisions of the Biggert-Waters Flood Insurance Reform Act of
2012. If it becomes official after a comment period that ends Dec. 10, 2013,
it will impact the way lenders handle homeowner's flood insurance coverage.
Agencies proposing the rule
include: The FDIC, the Office of the Comptroller of the Currency, the Board
of Governors of the Federal Reserve System, the National Credit Union
Administration and the Farm Credit Administration. If approved, it would
impact all loans under each agency, and it would apply to all institutions
that have less than $1 billion in assets.
Proposed rule highlights
* Lenders would be required
to accept private flood insurance policies for mortgage loans that require
coverage. To qualify, a private insurance policy must meet the statutory
definition of "private flood insurance" and adhere to the minimum
requirements under the Flood Disaster Protection Act.
* Lenders must tell
homeowners if private flood insurance is available, and encourage them to
compare rates and benefits of private coverage against those offered by the
National Flood Insurance Program (NFIP).
* Lenders must escrow flood
insurance premiums and fees, making the coverage part of a homeowner's
monthly mortgage payment. The proposed rule includes some specific details,
such as when lenders must begin escrowing, including a 90-day written notice
before escrowing outstanding loans. It also includes an exemption for some
smaller lenders, as well as for business, commercial and agricultural loans,
second lien loans, and residential condominium association policies.
* Lenders could still force-place a flood insurance policy on
any homeowner that drops or takes out too little coverage. However, the rule
would require the lender to terminate a force-placed insurance policy and
refund any payments within 30 days for overlapping coverage.

Mortgage rates surged lower
today following the long-awaited policy announcement from the Federal
Reserve. Conforming, 30yr Fixed rates fell to 4.5% with
some of the more aggressive lenders still competitively priced at lower
rates (best-execution). This doesn't mean that 4.25%
at one lender would be equivalent to 4.5% at another lender in terms of closing
costs--simply that the 4.25% scenario may be worth looking into to see if the
extra cost makes sense for you.

Real estate ownership rights for same-sex couples in Florida
Question: My partner and I are looking to buy our first house together, but Florida doesn’t recognize our marriage. Does the recent Supreme Court decision help us in terms of owning real estate? – Steve
Answer: Not yet. It’s likely to be a while before the high court’s marriage ruling trickles down to real estate law.
Typically, when a married couple buys a home, they do so as “Tenants by the Entireties,” which is a legal status of ownership that gives the spouses certain privileges. For example, when one spouse dies, the other automatically owns the property alone without any further action.
While same-sex couples aren’t allowed to own property this way in most jurisdictions, including Florida, a similar bundle of rights can be created. I have long advised that unmarried couples buying property together enter into an agreement regarding the management of the house. That pact also should specify what happens to the home if the relationship sours.
Same-sex couples should follow this advice as well. They can set up a trust agreement for the ownership of the house, and the details of the agreement can help decide what happens in the event of a split or death of a partner. Certain types of trusts can even provide for protection from creditors, if that’s an issue for you. So while the simplicity of Tenants by the Entireties ownership structure is not yet available to most same-sex couples, proper planning can give them the same legal protections.

Parents who find it financially difficult to buy new clothes for
their children's first days of school are asked to call: Peg at 283-3874 or
Mary Jo at 283-7862. All requests must be received no later than July 26th. The
above phone numbers apply to those who would like to "adopt" a child*
(see * below) or may wish to make a donation to this very worthwhile program.
Drop off point for clothes is Fire Station Number One at Pine Island Center.
For those who prefer to make a monetary contribution, tax-deductible donations
may be made to Pine Island FISH, indicating "Clothing for Kids" in
the memo line. Checks may be mailed to Pine Island FISH, PO Box 357, Matlacha,
FL 33993. *All family information remains confidential: only the age and first
name of a child is given to the adoptive person(s) to assist them with their

MATLACHA HOOKERS HOST BLOOD DRIVE- The
Matlacha Hookers are hosting a Pint for Pint Blood Drive Saturday, June 22nd
from 10:00am-2:00pm at Great Licks Ice Cream Shop, 4653 Pine Island Road in
Matlacha. Those who donate a pint of blood will receive a pint of ice cream.
All donors will receive a voucher for a free movie ticket, a coupon for $5.00
off two (2) entrees from Outback Steakhouse and a wellness checkup including
blood pressure, temperature, iron count and cholesterol screening. Please bring
